Offer & acceptance

Nothing on this site constitutes an offer in a legal sense. When you contact us you may offer to pay for our service and we are free to accept or reject that offer. Certain services may be dependent on payment being received from you as agreed before we accept your offer or in default of agreement forthwith upon that acceptance. Further, practical details are found in other parts of this site and you agree to be bound by those. Accounts provided free of charge may be suspended or terminated at any time at our discretion. No reason need be given for the suspension or termination of an account.


Warranty

We, Teachersemployment.org , will do all we reasonably can to provide the items you request but you agree that we are under no strict legal obligation to do so at any specific time or place, provided we have used all reasonable endeavours. Time is not the essence of this contract.

You, the client/advertiser warrant that your advertisement does not contravene any Act of Parliament, nor is it in any way illegal or defamatory or an infrigement of any other party's rights.


Indemnity

You, the client/advertiser, agree to indemnify teachersemployment.org, any of its subsidiary companies and each of their officers and employees against any and all loss (including but not limited to loss of business and loss of profits), liability, costs (including but not limited to legal costs), injury or expense and/or damages as a result of any failure by you or on your behalf to comply with these terms and conditions; AND/OR arising from any claim brought or threatened (in any jurisdiction) in which it is alleged that the creation, dissemination or exhibition of your advertisement/s (or any adaptation or part(s) thereof) infringes a third party's rights or is otherwise unlawful. You also agree to ensure that your advertisement/s and your conduct comply with the laws of the country you are advertising in respect of and to indemnify teachersemployment.org, any of its subsidiary companies and each of their officers and employees against any and all loss (including but not limited to loss of business and loss of profits), liability, costs (including but not limited to legal costs), injury or expense and/or damages as a result of any breach.


Ownership of data supplied

We own the data in our database/s and on our website, except that supplied by you. You cannot copy it, publish it or reproduce it to any third party without our express agreement in writing.


Amendments

This agreement cannot be amended save by our amending these terms on this page. Such amended items take effect 14 days after they are first posted. You agree it is your responsibility to check here for any changes.


Currency

All figures mentioned on this site or by our representatives are ‘Renminbi' (Chinese Yuan) unless we agree in writing. We will accept payment in Dollars.

Whilst we will use all reasonable efforts to provide the service we offer, our liability in so far as we can exclude it in law, is so excluded except up to the amount of monies paid to us by you for the service in question.

Subscribers agree that if removal or deactivation is required from the resume database, the subscriber must follow the removal/deactivation procedure as detailed within the teachersemployment.org site. A copy of the removal/deactivation procedure is available here or by contacting us. teachersemployment.org is under no obligation to remove/deactivate resumes manually. By uploading a photograph, audio or video clip (media file) here, you warrant that it is your original work and your copyright. We are not responsible for checking the originality of any media file uploaded, nor will we be liable for any copyright infringement. We reserve the right to delete any media file deemed in violation of copyright law. The creation, archiving within our system and the distribution of any resume or related correspondence we consider contains abusive or obscene material is strictly forbidden. Such resume accounts will immediately be suspended, pending investigation. No correspondence will be entered into and we reserve the right not to provide any reason for suspension or removal of a resume.


Job Postings

We reserve the right to remove any text considered in breach of our terms and conditions. Job postings may only include text directly related to a job vacancy. Teacher Training and course advertising may not be included in any job posting. Any job application processing fee or other charge which will be passed on to the applicant must clearly be stated in the advertisement. Advertisements failing to include this information will be suspended pending input of the said text and approval by teachersemployment.org. We reserve the right to remove any job posting which contravenes our posting policy. No refund will be provided. By uploading a photograph or image (media file) here, you warrant that it is your original work and your copyright. We are not responsible for checking the originality of any media file uploaded, nor will we be liable for any copyright infringement. We reserve the right to delete any media file deemed in violation of copyright law. Advertisers are free to amend content within their job posting, however it is forbidden to amend content to include new vacancies which were not part of the advertisement when originally posted. teachersemployment.org makes no claims as to the validity or accuracy of employment information contained within any advertisement and it shall bear no responsibility for the outcome of any positions to which an individual might apply. We simply work as a conduit for this information. Prior to accepting employment, Job-seekers are advised to fully research employers and request references where appropriate.

Resume Views
Resume Views provided to a registered employer may only be used by that employer under the registered corporate name. No Resume View credits or resumes may be passed to any third party without the permission of teachersemployment.org.

Complaints
We encourage users of www. teachersemployment.org to view the site and advertisers to advertise freely, as long as they do so in a responsible fashion and show respect for others. To ensure you and we are protected, we have developed a standard of conduct that is strictly enforced. This standard should be read with our Terms and Conditions for use of this website which contain important information about our liability and also our Privacy Policy. Adverts posted here may at our discretion be removed or amended, whether in breach of the standards or not, without further comment or notice to you. We reserve the right to identify you in response to a court order or threat of legal action. You agree in our Terms and Conditions to permit us to remove any such material. We may vet the adverts before posting. If we do so, then you still accept and retain all liability for the comments however edited. We can terminate this agreement by giving 28 days notice (or forthwith if we have reason to believe you have breached the terms of this agreement). You can terminate any agreement made with us providing you have complied with all terms of this agreement and have made payment for all services ordered by giving 14 days notice. PLEASE NOTE that you consent to the provision of the service starting immediately and therefore you will have no right to return the items under the Distance selling regulations.


Technical/IT issues and support

Whilst we will try to assist when we can, you agree that it is your sole responsibility to ensure your IT system is capable of receiving the materials by e-mail. We accept responsibility for sending e-mails to the address you give us but no responsibility for their receipt. We do at our discretion provide technical support, but this is not a part of this contract and we accept no responsibility for your IT/PC/software/viruses and any other problems of a technical nature with your equipment.


The law that applies

We are based in Beijing city, China , which is subject to law of RP.China. This agreement will be governed by and construed in accordance with law of RP.China. No effect will be given to any principle of conflict of laws.


Notices

Any notice required to be given to us can be given only by our receiving an e-mail or pre-paid letter at our Contact address given on the Contact us page of our site.


Severance

If any parts of this agreement are found to be unenforceable, void, illegal or invalid they shall be severed from this agreement and all the other provisions shall remain in force in full both as to force and effect.
